Ordentliche Gerichte in der BBD sind die
Amtsgerichte, die Landgerichte, die Oberlandesgerichte und der
Bundesgerichtshof. Das unterste Gericht ist das Amtsgericht. Es ist ein
erstinstanzliches Gericht. Das Amtsgericht entscheidet über
vermögensrechtliche Streitigkeiten bis zu 3000,- DM Streitwert.
Außerdem sind die Amtsgerichte ohne Rücksicht auf den Streitwert
für einige besonders eilige Rechtsstreitigkeiten zuständig. In den
bürgerlichen Rechtsstreitigkeiten wird das Amtsgericht nur durch den
Einzelrichter tätig.
Landgerichte haben meist einen Sprengel, der
aus mehreren Amtsgerichtsbezirken besteht. Sie sind teils erstinstanzliche
Gerichte, teils Berufirngsgerichte. Die Zivilkammern der Landgerichte sind in
erster Instanz für alle nicht vermögensrechtliche Streitigkeiten
(also namentlich Ehescheidungen) und für alle vermägensrechtliche
Streitigkeiten mit einem Streitwert von mehr als 5000,- DM zuständig.
Die Oberlandesgerichte sind Gerichte
für größere Bezirke, wenn nicht für ein Bundesland. Ihre
Senate entscheiden in Zivilsachen in einer Besetzung mit drei Richtem, in
Strafsachen in einer Besetzung mit fünf Richtern. In Zivilsachen sind die
Oberlandesgerichte zuständig zur Entscheidung über das Rechtsmittel
der Berufung gegen die Endurteile der Landgerichte.
Der Bundesgerichtshof (Sitz Karlsruhe) ist
das höchste Gericht für Zivil- und Strafsachen sowie für
Angelegenheiten der freiwilligen Gerichtsbarkeit. In Zivilsachen ist er im
wesentlichen Berufungsgericht. Dieses Gericht entscheidet über die
Revision gegen die Endurteile der Oberlandesgerichte.
